Terms of Service

These terms apply to TradeCommand, provided by TC Systems Pty Ltd (ABN 95 699 724 028) of 6 Lyster Street, Coffs Harbour NSW 2450, Australia. By creating an account or using the service, you agree to them on behalf of yourself and the business you represent.

The service

TradeCommand is job management software for trade businesses. It stores your leads, quotes, jobs, invoices and related records, connects to messaging channels and third-party services you choose, and includes assistants that draft and suggest work for a person to review.

Your account

• You must give accurate details and keep them current.
• You are responsible for what happens under your account and for the people you invite to it.
• You must not use the service to send spam, break the law, or infringe another person's rights.
• You must have the right to store the personal information you enter about clients and contacts.

Messaging channels

When you connect an email address or a WhatsApp Business account, you are responsible for the messages sent from it and for complying with the rules of that platform, including Meta's WhatsApp Business Messaging Policy and Australia's Spam Act 2003. We may suspend a channel that breaks those rules.

Your data

Your records stay yours. We use them only to provide the service, as our Privacy Policy describes. You can export or delete them as described on our data deletion page.

Assistants

Assistants in the service produce drafts and suggestions. They can be wrong. You are responsible for reviewing anything an assistant produces before you rely on it or send it to a client.

Fees

Fees, if any, are set out on your plan. We give at least 30 days' notice of a fee change. Where a plan includes a phone number or messaging allowance, third-party charges above that allowance are passed on at cost.

Availability and changes

We aim to keep the service available at all times but do not guarantee it. We may change or withdraw features with reasonable notice. We may suspend an account that breaks these terms.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent the law allows, our liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profit or lost data.

Ending the agreement

You can close your account at any time. We can end the agreement with 30 days' notice, or at once if you breach these terms. On ending, we delete your data as our Privacy Policy describes.

Governing law

These terms are governed by the law of New South Wales, Australia.
